Settlement: Two-Year-Old Child Falls from Improperly Guarded Third Story Window
Lake Success, September 26, 2024 (USANews.com) - The Pegalis Law Group, LLC, announces that it has secured a substantial pretrial settlement for an infant girl who suffered serious injuries when she fell from an improperly guarded third-story window to the courtyard below.
The infant plaintiff, age two, resided in an apartment in Brooklyn, NY with her six-year-old sister and her mother. On the day of the incident, the infant and her older sister were playing in the apartment. Suddenly, the six-year-old ran to tell her mother that her sister had fallen out of the window. The mother ran down the stairs to the courtyard where she found her child on the ground, unconscious.
The child was rushed to an emergency room where a CAT scan revealed a skull fracture. She had a post-traumatic seizure. After transfer to a pediatric trauma center, she remained in the hospital, in intensive care, for about a month. She received extensive rehabilitation services in the hospital and after discharge. Over time, with good supportive care, her condition improved. She sustained, however, a traumatic brain injury from the impact of the fall.
Nationwide there are thousands of similar accidents every year, most of which could be prevented with properly designed and installed window guards. In the City of New York, where this accident occurred, the Department of Health in fact requires that landlords and building managers install such guards.
The Pegalis Law Group’s investigation showed that the landlord and management company did not have a properly installed or maintained guard – as required by law – and that this allowed this two-year-old child to slip through the window opening, fall to the courtyard below, and sustain her skull fracture and brain injury.
